Builder fined thousands for misconduct

A builder has been fined almost $37,000 and can not undertake any work for the next two years for unprofessional conduct at a multi-dwelling domestic building site in Niddrie.

Builder Mario Mazza was fined $36,500 by the Victorian Building Authority (VBA) for breaches of the Building Act 1993, including allowing his registration to be used by another worker who had been disqualified from holding registrations for three years.

The VBA’s Executive Director Regulatory Operations David Brockman said Mr Mazza allowed Rocco Barba to use his Domestic Builder – Unlimited registration and was not permitted to do so.

“Mr Mazza should have known that allowing another practitioner to use his registration is completely inappropriate and in breach of the Building Act,” Mr Brockman said.

“In doing so, Mr Mazza gave Mr Barba cover to commit his own breaches of the Building Act, about which we have also taken action.”

The VBA also found Mr Mazza allowed and permitted work which did not align with the Building Act, the Building Regulations and the relevant building permit.

The allegations were related to a 15-unit residential development that is owned by a company controlled by Mr Barba, the person who Mr Mazza allowed his building registration to be used by.

Mr Barba was fined $38,000 earlier this month for breaches of the Building Act including allegedly providing false compliance certificates for a residential development, engaging in a sham building contract for the purposes of procuring a building permit and carrying out building works which significantly departed from the approved building permit documents.
