Tootgarook Swamp decision soon

A decision regarding the Tootgarook Swamp is expected to be handed down in the Supreme Court  of Victoria next week. The Mornington Peninsula Shire and landowner TJBP Pty Ltd are appealing a decision by the Victorian Civil and Administrative Tribunal last November. The matter relates to the shire’s approval of a planning permit for a 41-dwelling development at 85 Elizabeth Avenue, Rosebud West. Ashley Galvin of Moreheads Lawyers who is representing Tootgarook Swamp Incorporated, said it was now a matter of waiting until the judge made his final decision. He said his client objected to the shire and landowner seeking costs and maintained that the tribunal was correct in its original decision.
