Death row decision for Sunshine West dog

A Sunshine West dog owner will next month find out whether her beloved “Mylo” will be put down after a two-year legal battle.

Jessica Gray faced off with Brimbank council in the Victorian Civil and Administrative Tribunal again on May 12, after successfully appealing a council decision which said Mylo was a restricted-breed dog.

Mylo has been on death row since a council officer found him wandering alone and unregistered in 2012.

The council believes Mylo is an American pit bull terrier and should be put down. Ms Gray said she had DNA evidence which suggested he was an American Staffordshire terrier cross.

On May 12, VCAT ruled that a private meeting to be attended by a veterinarian, council prosecutors and a council ranger would be held at the Lost Dogs Home in North Melbourne on May 23 and 26. Those present would prepare a joint written report as to whether Mylo falls within three selection criteria to be deemed a restricted-breed dog under new state government laws. The report will specify the matters agreed between the conclave members, matters not agreed and the reasons for any disagreement.

An initial VCAT decision supported the council. Ms Gray appealed that decision in the Supreme Court. A final VCAT hearing will be held on June 5- 6.
